Acceptable Use Policy

1. Purpose

This Acceptable Use Policy explains the rules that apply when using Prismaya. It is intended to protect our users, their customers, payment providers, communications providers, and the Prismaya platform from unlawful, abusive, deceptive, or high-risk activity.

Prismaya may update this policy from time to time. Continued use of Prismaya after an update means you agree to the updated policy.

2. Who This Policy Applies To

This policy applies to all Prismaya customers, users, sellers, agencies, service providers, administrators, and anyone who accesses Prismaya or uses Prismaya to provide services to others.

If you use Prismaya on behalf of another organization or client, you are responsible for ensuring that your organization, your clients, your users, and your campaigns comply with this policy.

3. Permitted Use

Prismaya is a CRM and digital marketing platform. You may use Prismaya for legitimate business, customer relationship management, sales, marketing, communications, appointment booking, workflow automation, reporting, and payment-related activities.

Examples of permitted use include:

  • Managing contacts, companies, opportunities, tasks, and projects.
  • Capturing and following up with leads.
  • Sending lawful email, SMS, WhatsApp, and other customer communications.
  • Running marketing campaigns and sales workflows for legitimate services.
  • Managing appointments, meetings, events, and bookings.
  • Accepting payments for legitimate services, subscriptions, events, or invoices.
  • Providing CRM, digital marketing, automation, or implementation services to clients.

4. Compliance With Laws and Platform Rules

You must comply with all laws and regulations that apply to your use of Prismaya, your business, your customers, your marketing activity, your data, your products and services, and any payments you accept.

This includes, where applicable:

  • Consumer protection and advertising laws.
  • Data protection and privacy laws, including UK GDPR and GDPR.
  • Electronic marketing, spam, telemarketing, and messaging rules.
  • Payment network, card scheme, banking, and payment provider requirements.
  • Rules imposed by connected providers such as Google, Microsoft, Meta, Stripe, PayPal, email providers, SMS providers, and messaging platforms.

5. Prohibited Activity

You must not use Prismaya to create, promote, sell, process, facilitate, automate, or support any activity that is unlawful, deceptive, abusive, harmful, or prohibited by this policy.

Prohibited activity includes:

  • Illegal products, services, content, transactions, or activity.
  • Fraud, scams, phishing, impersonation, account takeover, or deceptive business practices.
  • False, misleading, or unsubstantiated claims in marketing, sales pages, offers, messages, or advertisements.
  • Spam, unsolicited bulk messaging, or communications sent without the required consent or lawful basis.
  • Harassment, abuse, threats, intimidation, exploitation, doxxing, or hateful conduct.
  • Content or activity that promotes violence, discrimination, self-harm, or exploitation.
  • Malware, credential theft, security attacks, scraping abuse, vulnerability exploitation, or attempts to bypass Prismaya or third-party security controls.
  • Attempts to access, copy, export, or use data that you are not authorized to access.
  • Infringement of intellectual property rights, including counterfeit goods, pirated content, or unauthorized use of third-party brands, images, lists, or content.
  • Use of Prismaya to avoid, bypass, or misrepresent payment provider, communications provider, platform, tax, sanctions, or compliance requirements.

6. Restricted or High-Risk Products and Services

Some products and services may be restricted or require Prismaya's prior written approval, additional due diligence, or proof of licensing before they may be promoted, sold, automated, or processed through Prismaya.

Restricted or high-risk categories include:

  • Financial services, investment advice, lending, debt relief, credit repair, or money services.
  • Healthcare, medical advice, pharmaceuticals, supplements, mental health, or regulated wellness services.
  • Gambling, betting, games of chance, sweepstakes, lotteries, or prize promotions.
  • Alcohol, tobacco, nicotine, vaping, weapons, controlled substances, or drug-related products.
  • Adult content, adult services, dating services, escort services, or sexually explicit material.
  • Cryptocurrency, digital assets, tokens, NFTs, or other speculative financial products.
  • Government services, legal services, immigration services, tax services, or other regulated professional services.
  • Any product or service that is prohibited or restricted by PayPal, Stripe, card networks, banks, email providers, SMS providers, or other connected services.

Prismaya may refuse, suspend, or restrict use of the platform for any product, service, or business model that we reasonably consider to be high risk, misleading, unlawful, or inconsistent with our payment or communications provider obligations.

7. Marketing and Communications

If you use Prismaya to send or automate communications, you are responsible for ensuring that each communication is lawful, accurate, properly authorized, and sent only to appropriate recipients.

You must:

  • Obtain and maintain any required consent or lawful basis before sending marketing communications.
  • Identify the sender clearly and accurately.
  • Include legally required unsubscribe, opt-out, or preference-management mechanisms.
  • Honor opt-outs, unsubscribes, suppression lists, and customer preferences promptly.
  • Keep contact lists accurate, lawfully obtained, and appropriately permissioned.
  • Comply with applicable email, SMS, WhatsApp, telemarketing, anti-spam, and platform rules.

You must not use Prismaya to send spam, misleading offers, deceptive funnels, unlawful cold outreach, or communications that violate a provider's terms.

8. Payments

If you use Prismaya with payment providers, you must ensure that all payments relate to legitimate, accurately described goods or services and comply with all payment provider terms.

You must not:

  • Misrepresent the product, service, seller, price, refund terms, billing cycle, or customer obligation.
  • Process payments for prohibited, hidden, or different goods or services than those disclosed to the customer or payment provider.
  • Use Prismaya to launder money, evade sanctions, avoid taxes, facilitate fraud, or obscure the identity of a seller or beneficiary.
  • Submit transactions that violate PayPal's Acceptable Use Policy, Stripe's restricted business rules, card network rules, bank rules, or any other payment provider requirements.

PayPal's Acceptable Use Policy is available at paypal.com/us/legalhub/acceptableuse-full. Your use of PayPal through Prismaya is also subject to PayPal's own terms, policies, and approval requirements.

9. Data, Privacy, and Security

You are responsible for the data you import, store, process, enrich, export, or share using Prismaya. You must have the necessary rights, permissions, consents, and lawful basis to use that data.

You must not:

  • Upload or process data that you are not authorized to use.
  • Use Prismaya to collect sensitive personal data unless you have a lawful basis and appropriate safeguards.
  • Share access credentials, bypass access controls, or allow unauthorized users to access Prismaya.
  • Use connected accounts, APIs, integrations, or automations in a way that exceeds the permissions granted by the account owner or provider.
  • Attempt to reverse engineer, probe, scan, overload, disrupt, or compromise Prismaya or third-party systems.

10. Agencies, Client Work, and Seller Responsibility

If you are an agency, consultant, reseller, implementation partner, or service provider using Prismaya for client work, you remain responsible for the accounts, campaigns, automations, connected services, and payment activity you create or manage.

You must not use Prismaya to hide the true seller, mislead customers about who is providing a service, route payments for undisclosed third parties, or operate client campaigns that would violate this policy if conducted directly by the client.

11. Monitoring and Enforcement

Prismaya may review accounts, campaigns, automations, content, transactions, metadata, support reports, provider notices, and usage patterns to detect and prevent policy violations, security risks, fraud, abuse, unlawful activity, or provider rule breaches.

If Prismaya reasonably believes that you have violated this policy, we may take action, including:

  • Warning you or requiring corrective action.
  • Removing, pausing, or disabling content, workflows, campaigns, automations, or integrations.
  • Restricting, suspending, or terminating access to Prismaya.
  • Holding, disabling, or referring payment activity to the relevant payment provider.
  • Notifying affected users, customers, providers, regulators, or law enforcement where required or appropriate.

Prismaya may take urgent action without prior notice where needed to protect users, customers, Prismaya, connected providers, payment providers, or the public.

12. Reporting Abuse

If you believe Prismaya is being used for unlawful, abusive, fraudulent, misleading, or harmful activity, please contact us.
